BT's complaint about a recent Virgin Media advert for its broadband service has been upheld by the Advertising Standards Authority.

BT had said that Virgin's "Hate to Wait?" campaign, that featured download times for songs and TV shows, was not clear and that Virgin's usage caps meant that downloads during peak times would be slower than advertised.

The ASA has ordered Virgin to make it clear that speeds will vary and clarify that download times would be restricted during peak hours for users on certain packages.

On another issue, Virgin had to agree to change the term "megabits" that it used to refer to file sizes to the correct "megabytes".
