British-based digital audio broadcaster Music Choice has won a "landmark" legal victory over the ownership of its trademarked logo, winning the highest-ever costs order ever made by the UK Trade Marks Registry.
The judgement confirms Music Choice as the rightful owner of its distinctive red and white bulls-eye logo, following a 4-year challenge by US retailer Target.
Target, which operates about 1500 stores in the States, claimed that it was the true owner of the rights to Music Choice's bulls-eye device.
But the Trade Marks Registry disagreed calling Target's case "hopeless" and ruling in Music Choice's favour.
The decision now means Music Choice has exclusive rights as legal owner of the mark to use the bulls-eye device in a number of business sectors, including retail services.
