Samsung will still have to pay $1.05 billion in damages to Apple as determined by the US patent-infringement trial judgement back in August last year. However, calls by the American company to have that figure tripled have been denied by Judge Judy Koh.

In addition, Samsung has been denied the chance of a new trial, even though it was found that Samsung did not wilfully infringe Apple's iPad patents. It was this finding that meant Apple could not petition for an increase in the damages awarded.

Other decisions reached during the post-trial proceedings include a rejection of Apple's claims that the original jurors were incorrect in determining that Apple's trade dress for iPad and iPad 2 - the aesthetics of the tablets - were unprotectable. The original decision stands. As does the jurors' conclusion that the Samsung Galaxy Tab 10.1 did not infringe Apple's design patent.

The judge also found that two claims of Samsung's patent covering wireless transmission over wireless systems were invalid.

At present, Samsung is yet to announce whether it plans to present any further arguments based on the fact that its patent infringements were unintentional or not. The new judgement, however, has seen a rise in its share value - it increased by 2.2 per cent in its homeland and city.
