Samsung has been given a date to appeal against the injunction set by a German court that bars the company from selling its Galaxy Tab 10.1 devices in the European Union (including the UK).

The South Korean company will put forward its arguments in court on 25 August, and is hoping to overturn a preliminary judgement made in favour of Apple. The Cupertino firm claims that the Tab infringes patents held by the tech giant in regard to its iPad tablet, and it's rather miffed about it.

Indeed, Apple released this statement to Pocket-lint on 9 August, after the original injunction was set: "It's no coincidence that Samsung's latest products look a lot like the iPhone and iPad, from the shape of the hardware to the user interface and even the packaging. This kind of blatant copying is wrong, and we need to protect Apple's intellectual property when companies steal our ideas."

Samsung responded, angrily: "The request for injunction was filed with no notice to Samsung, and the order was issued without any hearing or presentation of evidence from Samsung.

"We will take all necessary measures to ensure Samsung's innovative mobile communications devices are available to customers in Europe and around the world."

Samsung is currently unable to sell the Galaxy Tab 10.1 in all European Union members' countries, and runs the risk of incurring administrative fines if it continues to do so. However, some retailers who were supplied before the ruling are still selling stock (although Vodafone has postponed its pre-orders of the 3G version).

The latest development comes as an injunction has so far been unforthcoming in Netherlands, a nation that is exempt from the German ruling. With the judge in that hearing being unimpressed with some of Apple's evidence.
