Amazon has hit back at Apple in the App Store copyright lawsuit, citing its opponent's CEO in its defence.

The online retail king urged a San Francisco judge to throw out Apple's claim that it owns the rights to the phrase "App Store" (Amazon opened its own Appstore back in March) stating that the Cupertino company's argument was baseless and using a Steve Jobs quote as an example of how generic the term is.

Speaking on an Apple earnings call last year, the Apple boss said:

"So there will be at least four app stores on Android, which customers must search among to find the app they want and developers will need to work with to distribute their apps and get paid. This is going to be a mess for both users and developers. Contrast this with Apple’s integrated App Store, which offers users the easiest-to-use largest app store in the world, preloaded on every iPhone."

Does Amazon's argument sound familiar? Yes, indeed it does as Microsoft used exactly the same quote from Jobs in its motion against Apple back in January.

Apple's row with Amazon is more time sensitive however, as the Seattle based retailer is currently operating a platform actually named "Appstore" whereas Microsoft just wants clearance to use the phrase in the future - possibly for Windows 8. Apple wants Amazon to cease use of the name immediately and has filed to impose a preliminary injunction.

Why can't everybody just get along, eh?

What do you think? Is Apple being petty? Has it gone too far trying to trademark the words "app store"? Or should Amazon and others think of more original names for its application portfolios? Give us your thoughts below.
