Capcom wins Dead Rising lawsuit

Judge rules the game did not copy Dawn of Dead films

Capcom has won its court battle against the MKR Group, who sued the publisher claiming that its Dead Rising game had copied the format of the Dawn of the Dead films.

However Judge Richard Seeborg has ruled in favour of Capcom, stating that the video game offers no social commentary on the real world, unlike the films.

"It is confined to the killing of zombies in the process of attempting to unlock the cause of the zombie infestation," said the Judge of Dead Rising's theme.

"The social commentary MKR draws from Dawn of the Dead, in other words, appears totally absent from the combat focus found in Dead Rising."

The lawsuit reared its ugly head back in February. However it seems Capcom had pre-empted such a move from the MKR Group, which owns the rights for the horror movie, and had sought a legal declaration of individuality from the US court.

It is this move that seems to have paid off for the publisher.

Dead Rising 2 is currently in development with Canadian studio Blue Castle but few details are known as yet. We'll get them to you when we have them.
