The Guitar Hero lawsuit fiasco continues with Gibson shifting its focus from the game publisher to retail with news that it is suing five US retail chains in attempt to stop them selling the game.

Guitar maker Gibson has said that it is suing Wal-Mart Stores, Target, Kmart, Amazon.com, GameStop and Toys 'R' Us in the US to stop them selling Activision's Guitar Hero game claiming it violates a patent held by the company.

The federal lawsuit filed Monday follows a similar suit against Activision that we reported on at the beginning of March.

Gibson says the game violates a 1999 patent for technology to "simulate a musical performance".

Activision has already countered asking the US District Court for Central California to declare Gibson's patent invalid and also to stop it from seeking any damages. The case continues...
